Yes it was very confusing wasn't it. I'd always assumed it was 1898

Well, it is kind of moot for me.  That is the last centerfire rifle I will ever get rid of,   All but one other of my 1885s are pre 1898
  

People who think they know everything are a great annoyance to those of us who do.

I would save that letter if it is on ATF letterhead, and signed. Hearsay does not hold up well!!!! And I sold a lot of firearms and the year 1898 and earlier was the date that denoted Antique. It has been over 10 years since I last sold under an FFL license, but not aware of any change in the law?

Me too.  I have a HiWall 38-55 with no SN.  I am going to get a DST from MVA and will have a number put on it.

bpjack  the law actually states that a firearm is considered  antique having been manufactured in or before 1898. So a firearm manufactured in the year 1898 is considered an antique. Not as you stated, pre 1898, which implies otherwise. If it would make you feel more comfortable, I am sure the wording is available online.

Cbashooter  It won't be the first time a government employee is mistaken. That is why I mentioned keeping a copy. I also said that it had been a long time since I dealt with them, so the law could have been changed, but highly unlikely. To be on the safe side, until we know differently, I will use made in 1898 or before.

The key is over 100 years old in "obsolete caliber" .i had a well known collector message me with this confirmation he has from the ATF

I was aware of the obsolete ammunition clause, but not aware of a list of obsolete cartridges to include the 32-40 Ballard and 38-55 Ballard, unless they are considering the original Ballard cartridge being different than the 32-40 or 38-55 Winchester. As bpjack said, very confusing, but when dealing with the government, what isn't? It would be nice, but will likely never happen, to make readily available all current aspects of the 1968 act to other than FFL licensees. I would want a copy of such letter, not just a good friend told me. I dealt with ATF agents for a lot of years, and like with anything, some are good, some not so. I have asked three different agents the same question and received three different answers. That is not the way it is supposed to work. I would trust some of them about as far as I could throw them, others much more so. Sometimes hard to tell the difference. Hence a hard copy. Just my take.

Yes that's all I'm happy about.
I got the same answer from 2 different agents.
I think it's something that we need to look into for clarification.
