1885 Replaced Tang no serial # issue

My dealer received the rifle I purchased and the curved Tang is custom and does not have the serial number. he may have turn it over to the ATF because he said it is illegal to transfer. what are my options? Tang is a separate part so the receiver technically has no serial number.Its a late coil spring action.

I don’t know what your options are but millions of guns were manufactured without serial numbers before 1968. Could they just enter it in their books as no serial number?

I once owned a Mos action with no serial number and one was engraved on it for such transfer purposes.

Thanks for the input Joe I appreciated. I talked to my ATF agent and he said they're not horribly worried about a gun of this vintage and being that the Tang has the Tang has the serial number and it is not part of what they now consider an action they will just have the dealer book it in has no serial number

Back in the early years, Winchester only marked their name on the barrels and not on the top upper tang.  I purchased such a model that had been re-barreled with a no-name .22 barrel from Cabelas.  The handwritten invoice listed it as a Winchester High Wall, but the ATF paperwork was listed as an unknown manufacturer, unknown model.  WTF?  How would the ATF even trace it.  it did have a serial number on the lower tang, but it had a date that post-dated the missing Winchester name.  I could switch that tang to a different rifle and make it an unknown I guess.  The ATF might care if I ever figure out how to convert the action to full auto.

Thank you for everybody's input. Derek an ATF agent out of Seattle was able to clear everything up with my dealer and I able to take my Richard Hoch barreled highwall home with me.

Very nice and it is hard to tell does it have a single set trigger or am I possibly seeing something else?

There's lots of single-shot rifles out there without serial numbers. I have both Winchesters and Ballards sans numbers. One highwall out there somewhere has my drivers license number on its tang.

Yes it does have a single set trigger.
  Twist appears to be 1 in 16. I've been just playing around with seating depths for breach seating. I will shoot it Saturday

Here is atf response .over 100 years is antique in their eyes.

"Hello xxxx

Your Winchester model 1885 single shot in obsolete 32-40 ballard caliber that was manufactured before 1920 is 100 years old or older.  It would be considered an antique.  You may enter the firearm as a NSN with a description in the FFL’s books.

So, based on that statement, my 1919 mfg 32-40 high wall is considered an antique?  No FFL required for transfer then?

I am confused.
