9th Circuit Court incorporates 2nd Amemdment

The 9th Circuit Court has issued a ruling that incorporates the 2nd amendment into the 14th Amendment. By theory (don't hold your breath) this makes the 2nd Amendment binding upon the States, and not just upon the Federal government.

There are three kinds of men: The ones that learn by reading, the few who learn by observation, and the rest who have to pee on the electric fence and find out for themselves.

Wouldn't this only apply in the area covered by the 9th Circuit?

You're right, this would only apply to MT, ID, NV, AZ, WA, OR, AK, HI, Guam, the northern Mariana's, and CA.

Something worth noting:  This decision was made by a three judge panel, not the entire circuit court. If revisited by the entire circuit, the three member ruling could be nullified as an error.

The ruling against the Nordyke's is a sad defeat. However, since Alameda County prevailed, they are unlikely to appeal the decision and the due process incorporation may remain intact.

As blindeye noted, there may be future implications. If Heller's 2nd (post 06/2008 Supreme Court decision) filing against the revised D.C. firearm restrictions again proves favorable to Heller et al, effects could be felt directly within the 9th Circuit's jurisdiction.

Now I suppose cows will fly? The 9th is the most liberal court in the USA, and it's a truly shocking event when they vote any way that isn't truly liberal!
