Opinions Please... Who is on First..?

Print Post
Actual Scenerio:

So if I post an item for sale and in the bottom I say PM me. (in bold print)

Buyer "A" "First I'll Take it"...

Buyer "A" Writes I'll take it, PM to Follow (done within within an hour)
Buyer "B" a minute later writes 'I'll take it" PM to Follow

But Buyer "B" sends a PM first,

Who should I sell the item to ..?

Thanks for your opinions.

I encountered a similar issue recently. It’s awkward. Not sure there is a perfect answer to your question. I didn’t find one to mine.

The person who publicly responds " I'll take it".  As long as there are no conditions such as,: send pictures, trades, etc.
The way I see it, the definitive I'll take it seals the deal. No if's, ands or buts.

Bob (RJ-35-40) asked me for my opinion.  Here's my long-winded response.

That's a tricky question.  Here's a couple of examples I've experienced when selling items on the forum.

Example 1) I received a PM from a forum member that wanted the item but did not post "I'll take it" on the item for sale thread.  About the same time but a few minutes later, before I had a chance to list the items as sold, another forum member was the 1st to post "I'll take it" on the sale thread.  I decided I was obligated to sell the item to the guy that sent me the PM.  Therefore I had to inform the guy that said "I'll take it" that someone else had beat him to it due to sending me an earlier PM.

Example 2) A guy was the 1st to say "I'll take it" on the sale thread but had not had a chance to PM the seller.  Then another guy, a little later, was the 1st to PM the seller that he wanted the item.  In this example the guy that posted "I'll take it" on the sale thread should get it.

The bottom line from my point of view is 1st come 1st serve regardless of how a buyer notifies the seller.

I saw this post, and then after looking at the OP's posts, saw that I was the guilty party in this case.

I saw an ad yesterday, just posted, for a high wall action.  Seller said PM's first.  I sent a PM (for this item, and another item he also had for sale) and also did a post in both threads, trying to forestall exactly this from happening.  If I had just sent the PM, and someone else posted, then it would appear the seller sold to someone other than the first respondent.

In this case, there was no post before me when I typed in my post and hit send.  I didn't see the other post, truthfully until I saw this thread and looked.  My post, and RJ 35-40's, were literally posted simultaneously, from the standpoint of one or the other seeing the others post.  We were typing at the same time.

Not what I intended to do, cutting in on something someone else was trying to buy.  If he had messaged me that he thought he was first, I would have deferred to him.  If the seller told me someone else was ahead of me, I would have obviously deferred to them.

My apologies, RJ, was not trying to beat you out when you were first, I just followed the instructions to PM the seller, and then didn't see your post after I posted my message that I would take it.  I've already paid for this and the other item from the seller.

I always post a reply stating the I will take it IMMEDIATELY followed by a PM. Just covering all the bases.

BTW,
That next DST high wall action that anyone posts.  I will take it!

Been in this situation also. Told the seller "I'll take it" But sent a PM saying I wanted to see pictures before sending funds. The seller got several "I'll take it" after mine, and once I got the pictures I sent him payment. Fortunately he honored the first "I'll take it".

This has happened to me several times.  I post the first I take it and then informed I am not first.  This sucks.  If you can’t openly pick an item in open with a time stamp for everyone to see, then you do not deserve consideration.

Val,

You were lucky..!

My “I’ll Take it” was without any requests or conditions.

In this case the seller has decided to go with the #2 buyer, His
Excuses aside,
(Didn’t have time to check the site”) he has moved on and so have I.

MAYBE THE. MODERATORS, can make a formal Rule in the buy sell rule section that says, ‘ The first Unconditional “I’ll Take It” post prevails.

While this has been and still is the ethical approach, some folks have their own rationale.

I’ve received far too many  private messages from members who believe as I do, ‘First to post a commitment in the listing should prevail.
How else is someone else to know if it’s been spoken for.

In either case I wish Marcusp323 all the best.

My preference would be to give the option to purchase to whomever replies to the post with “I will take it”. I see no problem if that person has a question or wants to see a photo especially if no clear photos are in the original post. Making a lower offer though would void the first right to purchase.  Vall’s example should be the way to handle the transaction. An immediate PM should be sent to verify the request.  I do not like the idea of only requesting a PM as it leaves others with the impression that the item is still available.

What's on second, I don't know's on third. Bpjack's on the phone to his agent and Westerner's pacing in the dugout.

I like the public statement of intent, except occasionally I want a bit of privacy regarding my purchasing - as I suspect others do too sometimes. In that event I've directly PM'ed the seller and hoped that the contretemps described above didn't happen.
