Only issues I've ever had with both .38-40 or .44-40 were my fault. Getting in a hurry and raising the ram without the case fully into the shell holder, and it crushed the necks. They are thinner and crush easier than if I make that mistake with other brass, but not the case's fault.

I have had a perhaps misguided love affair with the 38-40 since I was 14 and wanted the pair of 1894 Marlin short rifles at the local hardware store for $35 each. Shotgun butt, half octagon, half magazine, mirror bores, all the original finish as I remember.  The guy would have let me work them off by sweeping the floor, etc.  My elders said Marlins froze up and wouldn't let me have them.  I have cried ever since but have had many 38-40s.  I now have  two Marlin 1894s, two Remington #1-1/2s, and a #2.  I have learned to avoid Winchesters.  I have a 5 shot 100 yd group from a Marlin that is less than 1/2" using 40043 and 20 grains 2400. I have a 50yd group from one of the 1-1/2s with 40043 and 25gr Reloader 7 that is only slightly larger than the bullet. (and Sherm Bell watched each round hit the target)  On the Marlin I had a 4X scope mounted using the Hepburn sight holes. The Remmy has a tang sight.  Don't tell me the 38-40 is not accurate.  401258 at 235 grains kills deer dead and I would not hesitate shooting one of our black bears, either.  Send me your 38-40s.

Gard, C Sharps offers the 38-40 in their lowalls, one of those with the single set trigger and a good set of sights would make a dandy target and hunting rifle.

My 2 favorite rifles are Colt pumps, one is 32-20 the other is 38-40... just for grins and giggles------

Seems this is a love / hate cartridge. I actually find it more intresting than the 44/40.

Ten Mile bet the issue they were talking about is the “Marlin Safety” two piece firing pin one part drops out of line when the Lever is down. It won’t allow the rifle to fire if the Lever is not all the way up and the block is in battery. 

They get dirty or over oiled don’t go all the way up & the gun won’t fire. No doubt cold weather same thing with stiff oil.

I have replaced all my 2 piece Marlin pins with one piece pins. Works much better.

I had a Win 1892 in 38WCF, bought it for the close coupled DST's.
It was fun to shoot, but always wished it was a 44WCF.
Can't say I would have wished the other way.

ten-mile, do you happen to know what the twist rate is in your Marlin 1894. I know my 92 Winchester is 1 in 36 and I was just curious if the Marlin has a faster twist and that's what made it so accurate?

38-40 WCF - 1 in 24"...Win 1892 (SN390000 to SN675000)
38-40 WCF - 1 in 30"...Win 1892 (under SN390000)

Decades ago when I bought my Brazillian Win 92 there were no newly made 92s, etc. in 38/40, at least that I could find. Caused me no problem cause 44-40 was of long standing interest. I have never regretted that 44-40. The originally rough Brazillian 92 was easily slicked up and the piece of stock wood they used was a nice piece of Braziallian hard wood that responded well to TruOil. It has often been taken for a "Real Winchester", albiet one made in Japan.

Smiley Art that picture was taken not long after I stumbled into that Colt. I got it brand new in the box, it's a 3rd generation but had never even had the cylinder turned,, until it got home. Tongue What's really sweet is the ideal loading tool with the built in bullet mould. The Colt really likes the bullet, but the Marlin 1889 doesn't feed it very well, it wants to jump the magazine stop and give the good ol Marlin jam, but the rifle feeds the RCBS 180 just fine.
