I know the answer, but I would like to know what you guys think about how a weapon qualifies or doesn't qualify as a Curio & Relic. 

The usual answer from a seller is "I need an FFL to transfer" quoting it has to be made before 1889 or 1898 Which tells me most of these guys don't have a clue.  They run an auction as a Curio & Relic and then ask for a FFL to transfer???  Angry

Since the C&R IS a FFL, they should accept it.  It has its limitations. but it still says it is a Federal Firearms License!

The ATF publishes a very large list of qualifying firearms. If I recall correctly, any firearm over 50 years old also qualifies as a C&R.

Is there a requirement that it must also be in an unmodified /unaltered condition?

No qualifications for modified or custom.  They care about the  date of manufacturer.    

Here are the rules:

To be recognized as C&R items, 478.11 specifies that firearms must fall within one of the following categories:

 Firearms which were manufactured at least 50 years prior to the current date, but not including replicas of such firearms;

Firearms which are certified by the curator of a municipal, State, or Federal museum which exhibits firearms to be curios or relics of museum interest; and

Any other firearms which derive a substantial part of their monetary value from the fact that they are novel, rare, bizarre, or because of their association with some historical figure, period, or event.


Items in bold taken directly from the ATF website.

Basically the Relic part of C&R is 50+ years old and the curio is anything that the ATF defines as special/unique/rare.

I've had an FFL dealer send me a rifle on my C&R FFL and he was not happy, his reasoning was that "I can't go online and check the database like I can on an FFL01".  I thought well who's to say your 01 is any more legit than my 03.  
Some people won't do it, but the majority of the good ones will.

I also received a big book on what qualified and I was surprised at a few of them.

I've bought a Ballard and a Borchardt barrelled action from dealers who had entered them in their bound book "just to be on the safe side".    Fear is the driving factor.

Normally, any firearm that can be shown to have been manufactured 50 years prior to the current year is eligible.  There are wierd exceptions, such as Type 53 Mosin carbines, for which there is NO exception, while they are identical to Model 44 Mosin carbines, either of which will be in excess of 50 years.  The Pre-98 cutoff is for antiques, not C&R.  I've had some dealers refuse my 03 FFL, but darned few.  All in all, the most expensive $30 per 3 year licensing period I've ever spent - gladly!

Hi Smoke,
FWIW, a piece of pipe could be a weapon, or a hammer, bow and arrow, spear, etc.
The NRA cautions it's instructors to use the term "firearm", perhaps it seems less menacing.
You might say every firearm is a weapon but not every weapon is a firearm, but that would imply the firearm is used in that manner and not as a piece of sporting equipment.
A baseball could be a weapon if thrown at you with bad intent, but it's generally not seen that way.

Yep. None of my many firearms are weapons, though years ago, I had a few military rifles that at one time probably qualified.

A foot makes a good weapon also, when attached to the right leg.
