Thought I'd post this for reference, as it seems that folks often confuse the early Marlin scopes with either Wollensak or Mossberg. Also for reference I am showing both styles of mounts for the #1 and #2 Marlin scopes.
These were made from 1936 on until the late 1940's. The #1 and #2 scope were the same, but the difference was the mounts. The #1 used a 3 point mount with locking rings on the adjustments, while the #2 used a 4 point mount with click adjustments. This was a real improvement over the #1 system mounts. Front mounts were identical for both.
Marlin scopes came in this gold box, with a bolt action Model 80E pictured on top with the scope. Inside there was instructions, application chart for all makes of rilfe, and a set of taps and drill bits. The Marlin scope patent was purchased from Sears, after they came to Marlin requesting they build these for Sears. Marlin bought the patent and agreed to build scopes for Sears, but under Marlin's name. The price to buy the patent was $1,000 in 1936.
